Drivers License

I was pulled over for suspended license due to lapsed insurance. I went to court with proof of insurance and was directed by the judge to get my license reinstated. I did so but missed my second court date due to work circumstances. A bench warrant was put out and when the police came to my house on a noise complaint I was arrested and taken to jail. They took my license and I never got it back. I looked it up online and it is still valid. My question is do I simply go get a new one or is there something else I have to do? I have a court date with the original judge later on this month. Thank you.

Hello: I just wrote a response...and hit a wrong button...and went off-line. Without repeating everything, let me say your license should be in the Court file. You should call the Clerk of Court--traffic dept. (give them the citation #) and demand it back.

Regarding the actual case, if you were interested in pleading, the State usually only wants to see you have a valid license. If you show it to the Assist. State Atty. in court, they will change the actual charge to "No valid D.L." and recommend just Court Costs be ordered. If you need more time to get a valid lic. or just to get yours back, the judge will let you pass the case to a later date.

You may also want to fight the charge. It could have been an illegal stop. Or, I just finished a case where a guy was charged with driv. on susp. lic. for no ins. He had papers to show he did have ins. And he had gone to the DL. office the next day, they showed it was NOT susp. and he paid $10.00 for a duplicate. The state dropped the charge.
