Legal Question in Traffic Law in Florida

Dui

Got a DUI in FL. Court date in Jan. My dad recently had a stroke in CA and I would like to go there to help. Is this possible?

Generally speaking, a condition of your bond is not to leave the county.

I am not sure if you are on bond or pre-trial release, the answer would be different depending on which.

If you were to leave the state, would you be home in time for the court date?

An attorney could file a motion with the judge who could grant you permission to travel.

I handle cases in Naples, give me a ring and we can chat further.

It is possible for you to go visit your father. Is the January court date the first court date? If so, you can have an attorney file a notice of appearance and plea of not guilty, and you should not have to appear. If you are moving out there permanently, it may be possible to serve your penalty out there. It depends on a number of circumstances. Is this your first DUI? Have you ever been arrested before?

If you would like to discuss the matter further, please contact my office.
