Legal Question in Traffic Law in Florida

Racing on Highway

I was recently charged with Racing on Highway, ''fast start, cant maintain lane & sliding''. I did start off fast but was not intentionally trying to race the car next to me. The car was also not mine. My question is; because I already have a bad driving record including speeding tickets, a reckless driving ticket, was arrested for driving while licencse suspended and lastly, fleeing and elluding an officer last year. I just cleared up everything and got my licencse back recently and now was charged with this; so im curious as to what will most likely happen to me when I go to court. I feel that because of my record i will not do well. I also do not kow of any attorneys in my area? Any and all help will be grestly appreciated. Thank you in advance,

Re: Racing on Highway

Hello: I just read your question. You did not state what city this case is pending. As such, I can only tell you what generally happens in Northeast Fla. jurisdictions. I'm also not sure if what you are charged with is a misdemeanor or just a traffic infraction. The citation should have the statute # written on it. This can be looked up to determine if criminal or traffic. If it is a misdemeanor, your criminal record will be looked at. You will have a choice of fighting the charge or entering a plea of no contest after negotiating with the State Attorney. The State and the Court will not deem this charge to be as serious as most of the cases they handle. So you should get a fairly reasonable offer.

I have not researched the "racing" statute in a while, but I seem to recall if one is convicted of that, his/her drivers license could be automatically suspended for a period. You need to confirm that if you are considering entering a plea. I can't be more specific without knowing the statute and researching the poss. penalties. Hope this helps. Tom Rosenblum
