Legal Question in Wills and Trusts in Florida

depositing will

Can i deposit my moms will at the courthouse? My sister says she was told an attorney had to do it?

Also my mom has 2 or 3 small things to probate.Bank account, car and we are trying to get into her safety deposit box at the bank.

Can we probate this ourselves or do we have to have an attorney?

Re: depositing will

Florida Statutes require the possessor of the last will and testament to deposit it with the clerk of court where decedant resided at her death. You can and should do this. If the estate is valued under $25000,and there is no debt, an attorney can obtain an Order of Summary

Administration for a modest fee.
