Can the excautor spend money when a will is still in probate. And how long does probate take in the state of Florida?

Yes, to file the probate and pay the attonrey fees, filing fee, publication fee. Probate will depend on what is involved. If there is property, lots of beneficiaries etc. The normal probate when the estate is small is around 5 months.

Some estates take 6 months; some take 6 years. It all depends.
