Legal Question in Wills and Trusts in Florida

Father died little over a month ago. Discovered he had a Savings account in his name only. Bank refuses to give us any details, we figure it had about $2,500 or so in it. Don't want to probate as creditors will come after us for $40k+ of credit card debt. Our lawyer says we can do a mini-probate, but he needs the account number - bank refuses to give us anything without court docs. What do we do? How can we get our money and protect ourselves please?

talk to the attorney again. miniprobate? will not likely clear the asset as the credit card debt will grab it. unless the account had a beneficiary listed it would be an asset of the estate. the estate would be subject to the known debt. as for the account number, your attorney can write to the bank and advise he is marshaling the estate assets and needs the account number.
