Legal Question in Wills and Trusts in Florida

MY husband died and he has almost 2 acres in Florida but we live in Texas, do I have to get a lawyer to convert the land from his name into mine. He didn't have a will and we have 2 biological children together ..he has no other children. We are wanting to get the property in our names. He owes no debt and has been deceased almost a year. Wanting to get closure .

You likely will need to probate an Estate in Florida to clear title to the property in your name. Contact an attorney in the County where the property is located.

It will depend on how the property is titled. If it is in his name only, probate will be required. A Florida attorney must handle the probate of the property. It should be a fairly simple process but needs to be done properly in order to protect the title. It will take approximately 3-6 months but could be longer. You should be able to handle without having to come to Florida as I have done these before for other people.
