Legal Question in Wills and Trusts in Florida

My husband passed away in 2014..I was on the mortgage of our home, but he had divorced me because of debt he did not want me responsible for (he knew he had cancer and did not tell me so). Were the children from his first marriage legally allowed to Petition for homestead status of real property and take the home from me? He left no will or any other directions written-only verbal.

You can always go see a local attorney to get a full opinion but from the limited facts provided I'd opine that the children would likely be entitled to the property unless you owned some portion of it (joint tenancy owner). There may of course be other facts which you don't even think are relevant but are to an attorney so you should seek out a local attorney and have a consultation. Hope this helps.
