Legal Question in Wills and Trusts in Florida

I live in Georgia, my mother, who was residing in Georgia at the time passed away. She left a condo located in Miami Florida to me in her will. What is the process to get the deed changed over into my name?

If it was in her name alone you have to file a probate in Florida to clear title. You need to hire an attorney to assist in the process.

If it's in her will and she died in Georgia. As you indicated, the correct procedure is for a Florida attorney to open a ancillary probate proceeding to probate real estate in Miami or any other city, so that's proceeds are the disposition can be handled ultimately by the probate court having jurisdiction over her at the time she died. I have worked on cases like this with other lawyers in other states and also helped clients find a lawyer to open up the probate in your Georgia. Since your mom died in Georgia, her will would be filed in the county she lived and died as a resident. I could coordinate the probate of real property anywhere in Florida. If you need assistance in this area, feel free to contact me at 561-502-1297 or my office at 561-694-6745 right now at my office located in Palm Beach gardens, .Florida. My condolences to you about the loss of your mother.
