Legal Question in Wills and Trusts in Florida

I have been living on some property for the past 3 years that my father owned and left to me and 3 other beneficiaries in his trust and will.

None of the other beneficiaries have any interest in the property I am living on and I have been given verbal and written permission to this property . We are in probate right now and the court is trying to force us to sell the property to pay my fathers debt. Is there any way to protect my home.

If your father passed three years ago and you did not probate his estate, his creditors may still have a possible lien. However, you should ask your probate attorney as to why he has not filed for homestead extemption.
