Legal Question in Wills and Trusts in Florida

lost will

How can a copy of a lost will be obtained when the name of the attorney who wrote it is not known. The will does exist. Would it be on file at the county clerk's office in the county in which it was written or is there a data base that would identify the attorney who has possession of it? Is there some official in that county who could help me?

If a will written by the deceased cannot be found the Court will usually assume the will distroyed by the deceased prior to his/her death. Wills can be filed with the local probate court before death, but that is seldom done. The probate court will tell you if they have a will on file. There is no data base to identify what atttorney helped write the will you seek. You may look for an attorney this person used in the past for help. If there any bank records showing an an attorney paid for services that might help you. You could also place an ad in the local legal news asking for help. Good luck.
