Legal Question in Wills and Trusts in Florida

Mother’s Will and subsequent Trust state per stirpes, and mother passed three years ago. One if her five children passed last year, leaving a wife and an adult child. Our mother’s Trust will be liquidated next year. Will the deceased son’s share of our mother’s Trust go to his spouse, or to his adult child?

Without having the ability to see the actually will or trust and with the facts as you're presenting them the share would go to the adult child. If you're trustee you'll likely want a solid settlement agreement, drafted by an attorney, and perhaps even court approval. Hope this helps
