Legal Question in Wills and Trusts in Florida

Both parents are deceased. Father died in nursing home Dec 2010. Had a house with 80,000 mortage and credit card debt. Nursing home drained all savings, which wasn't much. Medicaid was paying nursing home. Bank of America is now suing me for mortage. I have given them everything they asked for over the last yr., document wise. They harass me continually for the money. Now I received a summons saying they are suing me.

How can I possibly be held responsible. I'm in TN. father was in FL. There were no assets other than personal items in house, and two broken down older vehicles. This whole ordeal has costed me money, I've not made anything from his death.

Why are they suing you? You are not responsible,unless you signed the note.Do not default.

Unless you signed something guaranteeing the note and mortgage, you can't be held liable. If they are trying to hold you liable, you need to get an attorney to defend yourself. If you don't defend yourself, you will lose so don't take a default.
