Legal Question in Wills and Trusts in Florida

probate No Will

My brother passed away 7/9/05.

He was divorced with one son who is 19 years old.

There was no will at the time of death.

I am his sister and only surviving immediate family member.

I know this will have to go through probate court.

My x-sister-in-law has already seized the 2 homes, car, truck, small business and bank accts.,etc.

What is the process for contesting this?

I live in Utah but my brother lived in Jacksonville Florida.

I need to know specifically if I being his sister have any rights to the 2 homes, small business, bank accounts, cars and trucks etc.

If so I plan to hire an attorney in Florida.

Please Reply ASAP

Thank you,Deanna Thurston

Re: probate No Will

Only if he has no wife, no children, and no parents do you come into the picture. The son gets it all.
