Legal Question in Wills and Trusts in Florida

Exactly how do you proceed when there has been a breach of trust. Failure to report the yearly financial records - 2 years delinquent? Trustee has been asked repeatedly - nothing.

If you are a beneficiary of the trust, then you are entitled to an accounting of the trust assets. You can sue the trustee to receive an accounting. Typically in these type of situations, trustees have typically breached their duties as trustee. Self dealing or carelessness in managing the trust assets are common.

Mr. Bryant is correct. To force a correction is to file an action in court. It may include a demand for removal of the Trustee if circumstances warrant it.
