Legal Question in Wills and Trusts in Florida

real estate after owner dies?

My mother has lived with my grandmother for two years. My grandmother just passed away a week ago. The apt they lived in was only owned by my gmama but my mother helped with the expenses. My mother is the youngest of four. What can we do now to get the apt in my mothers name since she stil resides there?

Re: real estate after owner dies?

The home must go through a probate procedure in the Circuit Court for the county where your grandmother resided. If there is no will, and no spouse, the property passed to all the children, so for it to end up in your mother's name alone, the other children must deed their interest to your mother.
