Legal Question in Wills and Trusts in Florida

wills and estates

my dad passed away in 2002 and my stepmother never provided a will for me to review. she said that in Florida everything went to the surviving spouse. i found it odd because my dad had told me i would be taken care upon his death. at the end of terminal cancer he was on tons of meds and did not know who he was and always confused. now she has sold the house that he was on title too and is moving. what do you recommend? i have a good relationship with her but cannot figure out why nothing more was ever told to me.

Re: wills and estates

You should find out who was the executor of the will, and ask them for a copy. What is done by will, and what is done without a will (as what your stepmother was talking about), are two different issues. If one has a will, then the assets of the estate are distributed in accordance with the will. If there is no will, then the property is distributed according to Florida law. I would contact the probate court in the county in which you live.
