Advantages of Settling Workers Comp claim?

In November of 01 I reported a wrist injury to my employer and began treatment. Specialist visits led to Surgery in February of 2002. The pain returned and after trying injections which did not work opted for a second surgery January 03. This ''fixed'' a different problem. After this second surgery Doctor informed me of ligiment damage which would cause problems down the road. I am still in pain and have to return to the doctor in 3 months with another Surgery a good possibility, and then continued doctor visits every year, possibly more surgery down the road. I no longer work at the employer with which this injury occured, my new employer tells me I may want to settle this claim. With all of the potential medical needs in the future why would this be a good option for me? The pain is significant, but I am learning to live with it. Former employer has not contacted me about settling, but would they offer enough to compensate for possible further medical needs? Why is this a good option?

When a claimant settles a case the employer/carrier will evaluate your future medical needs and include those values for future medical care, and potentially indemnity (wage loss),if you are entitled, as part of the settlement. This way you are free to visit any doctors you wish, and are no longer in the workers compensation system. If your employer is insured by a Workers Compensation Carrier they will want to know if you are interested in settlement.
