Legal Question in Workers Comp in Florida

My fiance fell off a roof while on the job, went to the hospital and found out he has 3 fractured ribs. He is in severe pain, and can barely move or walk. His boss doesn't have workers comp, and the lawyer my fiance contacted said his boss was at fault. What can he do? The lawyer says there really is no case, but my fiance is sure his boss is going to let him go. We live in Florida. What are his rights? What can we do? Im the only one working while he's recovering, and we have no money to get him to a pain clinic. Are there any programs that can help us afford to take him to a pain clinic and get his prescriptions? Any kind of help would be appreciated.

Under the law, if the employer has no wc insurance, you can sue the employer in tort and the only issue is damages.

Seek a new lawyer.
