Legal Question in Workers Comp in Florida

If my primary physican wrote a refferal to a Dr. and workers comp sent me to some one else in the system can they do this ? Iwas told that it should have been the dr. he reffered me to and he wrote medical necessary on the script and requwsted it two times. Can they be in trouble for this or can I tell them I want to go to the Dr. that my primary has reffered me to.Thanks for the help. Also I read that it should only take up to 3 days for workers comp to comply and it has been almost two weeks. Is this true?

Unfortunately, the present workers' compensation law does not allow doctors to make direct referrals to specific doctors, only to a specialty (like an orthopedic or neurologist). The carrier does have the right to choose the doctor. The present system is stacked against injured workers and highly favors insurance companies. That is why it is important to get representation so that you have someone on your side who can assert your rights in situations where there are some favorable loopholes for injured workers.

I recommend that you obtain the assistance of an attorney to help you. The delayed referral is a violation and an attorney will keep them honest and get paid for this by the wc carrier. See FL-PI-Lawyer.com
