Temporary Benefits

In December the insurance company stop paying me benefits because the doctor said that I could return to work(contsruction) work) without any limits. I constantly told him that I couldn't. In Jan. I finally had a ultra sound done which revealed scarred tissue. This same doctor referred me to a pain specialist and the pain specialist put me on a no work status. He saw that I was not able to perform as the doctor said that I could. How I can I receive my compensation from the month of December-February? Later they begin to pay me because the Pain Specialist said that I had not reach MMI. From the month of March until June they have compensated me, but not for the loss compensation. And now I haven't received any compensation in about 5 weeks, even though the pain specialist has referred me back to my primary care physician. He stated that there is nothing else that he can do for me. My primary care physician has ordered a CT of the groin, but yet I still haven't received any benifits. What can I do? How can I receive the benefits that are owed to me? What can I do about this situation? What are my rights? Do I have a right to be compensated? Help

You do have the right to be compensated for the months you were taken off comp and for the time spent waiting to go back to your primary and get the ultrasound. You could just call the adjuster on the file and ask for the money. The adjuster will likely have some excuse for not paying, like no medical evidence of disability during the periods of time in issue. That means you can either go away unhappy and uncompensated, or you can hire a board certified workers' compensation lawyer to file a claim for you.Good luck.
