my workers comp will not let me get a second opinion doctor of my choice is this legal and also there doctor wanted a second opinion for another surgury and they flat out refused his prescription for it can they do that ?

That depends whether the carrier has opted out of managed care or not. Usually if the doctor recommends something, they have to comply. The carrier not complying is just another reason there is so much litigation in the comp system. You need to file a Petition for Benefits or contact the Employee Assistance Office. You can always have an IME with a doctor of your chosing at your own expense. It will cost you money, but it will get you the additional opinion you want before having surgery. Of course, I would recommend fighting for the second opinion at their expense first. Feel free to email or call if you need to discuss in detail.
