Legal Question in Construction Law in Georgia

I just had to have the sewer line in my house fixed. The plumber tells me the pipe was broken when the town homes were build, about 8 years ago. My homeowners insurance does not covers any of it, and the homeowner association claims no responsibility for it as well. Is the builder of the community somehow responsible, since the pipe was not installed right in the first place?

This is a general answer regarding responsibility. Homeowner associations are usually responsible for common areas and not the town homes. Your homeowner's agreement with the association should spell out their responsibility. If it was a condo, you might have a different answer.

Even if you wanted to go after the builder (which he probably doesn't exist anymore), it might cost you more to bring the case than what it is worth. You will need to get your plumber to testify and will likely need to hire an attorney. It would have to be a very expensive fix to warrant the time and money it would cost to bring the lawsuit.
