Legal Question in Appeals and Writs in Georgia

Writ of Fieri Facias

Suit against me in Ga Magis Court for past due bill. After service I contacted the Attny's office that filed it, spoke with a rep. Lesser amt and terms agreed upon. Answered complaint in person. Judge verified terms with the Attny's office, issued a Consent Order reflecting the agreement. Order allowed a 10 day grace period before a Judgement would be issued if I defaulted on Consent Order. I followed the terms of the order exactly. Pmts were taken directly from checking acct by the Plaintiff's attny on 3 ordered dates. 3 days after the final pmt the attny issued a Writ of Fieri Facias to create a lien against my property. The writ referred to a judgement 7 times and stated that I had defraulted. THERE WAS NO JUDGEMENT!!! I HAD NOT DEFAULTED!!! 10 DAY PERIOD IGNORED. A worker in the Magis office signed Writ in place of Magis judge, that file had been reviewed by the Judge and that Writ was accurate. Writ filed in Super Clerk of Court office and cancelled 20 days later by stating the lien had been satisfied. Info can now be seen by public on GSCCCA.org website. THIS IS A FALSE DOCUMENT!!! A LIE FILED IN SUPERIOR COURT CLERK'S OFFICE!!! I feel slandered and mistreated. Judge said will correct but has not after 2 mths. Pls advise.

Re: Writ of Fieri Facias

Call the judge's office to check on the status of the order and the expected timing of the date of the order.

Also, if you believe the attorney deliberately filed a false lien, file a complaint with the Georgia Bar against the attorney.
