I had a stay lifted and my former attorney refuse to submit an appeal if my case is thrown out can another attorney refile my bankruptcy right away

Probably NOT, but no lawyerwho has not seen your complete case file will know. In most refilings you either have no stay or a 30 day one, depending on the facts. You may also have a bar on filing. And any stay is probably NOT effectiveagainst a creditor that already got a stay lifted. Many BR interim rulings are not appealable, or would have subjected you to sanctions or attorneys fees and a lawyer refusing to file one was likely for that reason. But NO ONE will be able to tell yu for sure online. Only a review of the complete case file can give an answer.

Probably ... maybe... but we don't have the details. Whether that gets you anywhere is a different issue. You'll have the same judge and probably will get the same result. You lawyer is not going to do extra work in filing a useless, if not frivolous, appeal.
