Legal Question in Business Law in Georgia

Business Name

We're looking to open a business under the name Hall's Natural Products. We are wondering if there could be any repercussions or trademark infringement issues from Halls Natural (cough drops) in the future? It's our name so we'd like to use it in our business name, but we don't want any issues down the road. Thanks for your help!

Since you are asking for a guess as to what the other company will do, yes there is a chance they will have a problem with your name.

Re: Business Name

Because there is a reasonable chance of consumer confusion, there is a real possibility that your proposed business name will be considered an infringement on the Hall's trademark. Of course, you never know what the holder of the Hall's trademark will do regarding enforcement of their trademark. However, in either case, I would not recommend investing time and money in a name that carries such a risk.
