Legal Question in Business Law in Georgia

Hotel charging for services not received

Can a hotel charge for a room that was not used? An attempt to cancel a hotel reservation was not allowed by the hotel due to a 60 day cancellation policy for certain weeks during the year. The reservation was attempted to be cancelled after the 60 day policy (51st day). Confirmation of the reservation had no indication or reference to a 60 day cancellation policy and it also stated the credit card would be charged immediately at booking or at time of checkout (hotel was booked in Sept '06) The credit card was billed 43 days prior to the scheduled stay of April 2 and 3, 2007. The amount is for $1070.00 USD.

They probably gotcha. These folks have been revising their policies for many years with an eye toward protecting them and sticking it to you. If it's worth it to you, have a local lawyer flyspeck the policy.

You agreed to the terms and conditions of the reservation when you made the reservation, whether or not you read them. We can't guess what the policy is, or was, or how it was communicated to you. You fail to state how you made the reservation, among other details.
