Legal Question in Business Law in Georgia

Patent TM or CR??? question

I have a new sewing product that I am interested in producing, marketing and of course selling, I am working with a company to make the product to my specs and I will do a sample package. What do I need?? A patent or CR or TM? Can I sell my idea to a company after I do what's necessary? How do I protect the name and packaging itself?? There is nothing on the market currently and I know many people would use this product, I can't believe no one has ever thought of this one! Thanks!!

Re: Patent TM or CR??? question

Ideas are not protectable property absent a contract. You are creating a physical product, you will probably need to patent the product. There may be some trademark issues surrounding the name of the product, packaging, etc. I would highly recommend speaking with both a local business and intellectual attorney.
