Produce Sales and General Merchandise

Do we need any type of license to sell produce and general merchandise from a home based business?

I would start by contacting your local health department and business license office. Also, if you can find a similar business in your area that has been down this road before and had an attorney advising them, that attorney may be able to walk you through it.

You probably should obtain one. If the county that you are operating in discovers that you did not license your business, then it can assess penalties on the income that you made during the time your business was not licensed. You may also want to register with the secretary of state, under a status that will limit your personal liability in the event one of your customers elects to sue you.

The answer depends largely on the county in which you reside and/or run the business. We do not know where that is. Call the local taxing authority and ask. You may or may not need to crate a corporation or LLC to avoid personal liability (it is not done by merely "registering"), but to find out you are best served by seeing a local lawyer and CPA who specialize in small businesses and review what you want to do.
