name of a product I will sell

Can my name be the same as someone elses, except my spelling would be different. How do I know what names are already out there?

The answer really depends on many factors not listed in your posting. The different spelling probably won�t help you, but the geography and type of industry might. I.e. if the names are used for products in different industries so there shouldn�t be any consumer confusion. Speak to a local business and intellectual property attorney.
