Stealing my website and moving to another domain

I was employed at a company for the last year in which I created and maintained a web site for free. This was not part of my job requirements nor did I have a contract with the company. I quite this job in September and our understanding was that I owned the web site and content. I removed the web site from their domain and today I have found out that they copied my web site (contents) and placed it on their other domain. Do I have any legal rights to have them remove the contents the I created?

You probably do NOT own the websitore contents. Because you were an employee this is probably work for hire material, which means the employer and not you is legally the author. For you to be the author there would need to be an agreement in writing to that effect. In the absence of such an agreement, generally the law writes an agreement for you that the employer owns the work.

You might make an argument that this was not within the scope of your employment, but the course of events is such that I doubt you would win that argument.

Still, with an experienced copyright lawyer representing you, your lawyer might demand compensation for you and might obtain it. Just recognize that by failing to get an agreement in writing, you have jeopardized your case.

Federal law governs copyright (i.e. work for hire), but state employment law may come into play. I can advise on Texas law, but not Georgia law. But, you are not a client and we have no attorney-client relationship so please recognize that you take this advice completely at your own risk.
