Breach of Contract

I've signed a contract two months ago for home improvement (to make wheelchair accessible). The company keeps putting off the job. They finally sent two men over who didn't know what to do and who smelled like alcohol. I now want my down payment (8,000)back and out of the contract. There is a clause in the contract that states: "All work to be completed in a workmanlike manner according to standard practices...All agreements contingent upon strikes, accidents or delays beyond our control" There is also a contingency statement that the contract is contingent on financing. Do any of these contingency statements give me a legal "out" of this contract?

Either one of these may give you and out but you probably are going to have to sue to get your money. I have found that once these guys get your money only the reputable ones are willing to work with you to make the situation right.
