Legal Question in Consumer Law in Georgia

Can Debt Collector Look at Available Account Balance of your Credit Card?

Got call from debt collector for the medical bill of my wife's delivery $2,700. The collector said we have looked into your credit card and see that your wife has THIS amount of credit available. You can pay this debt with that credit. Moreover, refused to negotiate saying you can pay with your credit card. During multiple calls, agreed to a instalment payment plan, but later when I called to give account and routing number, another lady said "I'm the floor manager, the lady you talked to did not see the flag on file, we would not accept payment plan as you have credit available'. In the last 2 calls, twice mentioned turning case over to attorney or such individual. When I said 'are you threatning me?' replied 'No' but I took it she really was trying to scare me. When I asked her to send me the bill details, she went furious and wanted to put the phone down. I had to make her keep talking, eventually she did put the phone down.

First of all, you do NOT negotiate by phone. EVERYTHING needs to be in writing. Second, NEVER give any creditor your checking information! If you pay by installments, use money orders.

Collectors certainly can get credit information about you, and they may thus know about your resources.

You would benefit by talking to a lawyer rather than continuing what you are doing.
