hurting a child

Me and my son were at our local walmart and we were checking out at the self ck out and one of the employees who was monitoring the area came up to my son and pulled his ear lobe so hard that it made him go to his knees. He is only 7 yrs old. The man told him that he needed to listen to his mama and be good even if he was acting up which he wasn't that wasn't his place to do that. we contacted the manager and they put us with a claims manager they offered us $1,ooo. but little did they know that my son has had major ear surgery on the that ear and has MRSA and we have been having problems with that ear for over a year. I know that the employee didn't know that first of all he shouldn't have ever touched him even if I did know him. They told us that he was fired. We feel like that we deserve more. Our son was traumatized by this he will not go back into walmart and was embarassed. He didn't do anything wrong. We are would like some input from a legal stand point.

Whether or not $1,000.00 is a fair offer depends on several factors that are impossible to discuss in this type of forum. E.g., will the child need additional medical treatment? Did the pulling do damage,e.g., to a closed incision? Consult with a local attorney.

Wal-Mart is a bear to deal with. Get an attorney but know that it is going to take a long time to resolve this matter.
