Legal Question in Consumer Law in Georgia

Your mother ordered a sofa on sale at Raffertys Furniture and when she got it in her house, the color of the sofa did not look good with her wall color. She called the store and told them to take back the furniture, but they said they dont give refunds on sale merchandise. She wants to know if she can make them give her a refund.

She can't. There is no law in Georgia that requires merchants to undo a sale. Some may choose to (and you can ask), but you don't ever buy anything you aren't sure you want unless you have a written return policy in hand (that written policy can be enforced).

The first thing we need to look at is the receipt. I want you to look at the front and back of the sales receipt to see if there is any disclaimer language, such as all sales are final or no refunds on sale items. There may have even been a sign at the cash register stating that all sales are final. If you've received this notice, then "all sales are final." But don't stop there, I would still approach the store manager in a friendly manner and ask for a store credit.

Let me know what you find out. Please visit our website: kaidenlaw.com and please feel free to contact me. I am a Georgia consumer lawyer.
