Legal Question in Consumer Law in Georgia

purchase of a new vehicle suv

After signing contract for purchase of new 05 Ford Expedition, received call from dealership day later stating incorrect vin number placed on contract reflecting sale of top of the line Eddie Bauer Ford Expedition a more equipped vehicle. Dealership is requesting a signing of new contract for the less equipped vehicle I received however without change in purchase price or figures. Am I entitled to switch out vehicles for the Eddie Bauer version as reflected in the original contract if invoice prices within the contract reflect sale of the Eddie Baurer vehicle? I want to make sure I am not receiving the less equipped car at the more expensive price.

Re: purchase of a new vehicle suv

In some cases of a mutual mistake in a contract, the contract might be voidable, but that's a complex question depending on all the details of the transaction. I'd do some homework, see what you should have paid (call some other dealers), and maybe haggle some with the dealer's owner or manager (NOT your salesman). If the price was fair, suggest that for your incovenience they give you a couple free service visits. If the price is way off (something you should have addressed before signing) this MIGHT be a chance to haggle some. Bear in mind they may have grounds to hold you to the intended agreement, so don't push the envelope too far unless you sit with a lawyer first and have him determine all the details.
