Rent a car lawsuit

last year on April 2, my son was involved in a car accident he was a back seat passanger. Another car hit the car he was in and kept going. No in the car had a licence except my son. So the driver lied and said he was the driver. He told the police he was not driving but they took his information anyway.The car he was riding in was rented by the driver's mother. The person driving was 16. Everyone else was telling her she know she was not telling the truth. Later on it came out and she told the truth that she was driving. I called the police station the next day and they said they had nothing on my son. To my surprise just last week we receive a notice from a lawyers office suing my son for the rent a car on behalf of the rental company. Alledging he is responsible for monetary damages as a result of a breach of a binding and legal enforceable contract. The car was rented by the girls mother and not my son. At the time my son was 17. Again to our surprise after speaking with the respresenting attorney she say's the police report has him listed as the driver and was never changed from the girl confessing she was the driver. My son was not giving any ticket or notice to appear in court for anything. Please advise. Thank you

Don't pay any attention to what anybody else is telling you. Lying about who the driver was may have consequences in traffic court but does not necessarily have anything to do with who was at fault. Consult with a local attorney (but do it ASAP since suit has been filed and it MUST be responded to) about who is responsible for what.
