Legal Question in Credit and Debt Law in Georgia

car towed by HOA

My truck was towed by my home owners association, because I was behind in my dues. I live in a townhome community. My check had cleared a day before the towing occurred and that check made me current on all outstandind debt. The management company told me that they had not received that information on my check and it was too bad. What are my options in recovering my towing fees and am i entitled to other compensation?

Write a letter to the appropriate person, attach all relevant documents showing the dates (incl. copy of canceled check), send it certified mail, and keep a copy. You say the management company said they didn't have the info - now they will. Follow up with a call, and discuss the possibility of deducing the towing fees on your next payment. Paying a lawyer to recover towing fees is likely a waste of someone's money.
