Legal Question in Credit and Debt Law in Georgia

If a couple want to marry, but both have been married before and both have bills. For instance she has a mortgage on her home, but he has really a lot of debts, does she become liable for his debts after marriage? Can anything be drawn up that says her debts are hers and his debts are his but anything incurred after marraige is mutual? I ask this just in case anything should happen to either of them would the other have to pay off all the debts?

While there is no automatic liability for the other's debts, there are some things each of you may want to protect and a prenuptial agreement can cover such things. That requires a lawyer, but is not expensive.

You don't need anything, but if it makes you feel more secure, get an local attorney to prepare a "hold harmless" agreement.
