Legal Question in Credit and Debt Law in Georgia

I'm being taken to court for a bill that my fiance is paying on in his backrupcy case. Can they do that. They are already getting paid. Now they want me to pay also. So then they will be getting double payment. Can i sue them back, He filled total backrucy. And they are being paid thru that, with instrest.. Now they are telling me that i owe the full amount. The debt is in both of our names.. Can they do this?? His attorney, told him they can't do this. Because they are being paid. And they excepted , with out fighting. And they also signed off on it. Saying all is ok.. Any ideas on what i should do. Call them, sue them what?? please help me.....

You don't say much more the second time, other than confirm you owe the debt. You received a response to some of your questions. "Total bankruptcy" is not a legal term, and tells us nothing about his bankruptcy case. Your best option is probably to ask your questions to the BR law, or hire a lawyer to defend the case.

Your post makes absolutely no sense. I am guessing you cosigned a debt with him.

If he filed total bankruptcy (called Chapter 7), they CAN sue. That case does NOT protect you and you get to pay in full. His lawyer cannot give you legal advice since he is an adverse party to you.

Get your own lawyer and do not call his lawyer.
