Ripped-off! They have my $4,150. I have nothing

I purchased a bdrm suit off Ebay(pob in GA) back in Apr. for $4,150. They were to deliver it in june. The day of delivery the guy calls, say's he's been rear-end, suite is destroyed. It's been a nightmare since then. Ebay can't/won't help because it was 61days from purchase date, 60day is their cutoff. I've contacted the police in GA., the sheriff, the court house.........no one will help me.

The police said they went out and ''talked to'' the guy. For 2wks these people have said they were sending my money. Said they'd send $1000@wk. Nothing, I've gotten nothing. When I tricked them into answering my call today all he would say was ''We're working on it.''

What....What....What can I do to get my money back, all in one lump sum, not this dribble back? Can I sue them for fraud, larceny, misrepresentation of a business, and any & everything I can possible charge these low-life gutter trash with?

Please help! $4,150 is a lot of money for us. Looks too as if it's just going to keep costing *me* to get back *my* money. Help please!

The answer is not one that you want to hear, but to have any chance of recovery (assuming they will not voluntarily pay) you'll need to file a lawsuit in GA. While one can file a small claims lawsuit without an attorney, you'll need to get one to handle it properly without you having to come here to do everything. You will need to appear at the trial to present evidence. If you win, you will need to collect, which is another hurdle. Unfortunately, this is the risk people take by making large purchases through online auctions, especially when there is no recourse through the credit card, ebay or paypal (which I know little about). Consider paying a lawyer for an hour or two of time to write a demand letter and see if that gets you anywhere.
