Legal Question in Credit and Debt Law in Georgia

i am a truck driver/owner who a company has bounced a 1900. check on and wont pay me on my last 2 loads makeing the amount around 5-6000 how do i go about getting my money

Most states have bad check laws. I have not had to do one for Georgia and would have to research the exact procedure, but they are all basically the same. Is the debtor in Georgia or in another state? I am only licensed in GA, PA & NC. If the debtor is in another state, you may want to try an attorney in that particular state.

State law requires you to send a written letter via certified mail. If the debtor does not pay up, then you can either go the civil or criminal route. In most states it is a crime to write a bad check and given the amount, this is probably a felony. You would then take a copy of the letter that you wrote and the return receipt (green card) to the district attorney in the county where the debtor resides or has an office. The district attorney then sends a letter except now there are costs added in. If the debtor still does not pay, then the district attorney prosecutes. Or you can try civil court by doing a small claims action where the person lives or has an office.
