Legal Question in Criminal Law in Georgia

Charged with possession of Exctacy

I was arrested the year before last with possession of extacy (3 pills). I was originally being charged with one felony but the DA made it two because the drug lab said it was cut with meth. Now I'm being charged with possession of extacy and methamphetamines. I have absolutely no record. Will prison time be mandatory? Or can I use my First Offender's?

Re: Charged with possession of Exctacy

If you are convicted, whether you receive a prison sentence is up to the court. The DA can recommend probation, first offender, or prison; depending on where they stand. However, there is nothing in Georgia law that would require a prison sentence for a first time drug offense. Please contact me if you wish to discuss the matter further.
