Hi, Yesterday the police came to give issue a warrant for my older brother who I live with for a previous drug offense. My brother was not home at the time, and b/c my brother and I live in a ''hotel'' at the time they said they could just come in and look around. While looking around they found a baggie of marijuana in a cup on a clothes chest. The officer wrote me a ticket for possesion of marijuana(less than 1 oz.). I go to court on May 21. I have NEVER been arrested for anything before. What should I do?

You should hire a lawyer to review the leag;lity of the search. The police officer may have been wrong about his right to search your hotel room.

I do not think that the police can just come into the room unless they could see the pot from where they were standing. A motion to suppress all drugs found in the room must be filed at the time of arraignment, otherwise, you waive your ability to contest the entry into the room.
