Legal Question in Criminal Law in Georgia

Georgia's First Offender ACT / LAW

I was convicted and allowed to enter under the First Offenders act/plea. This was 10 years ago when i was 17, turning 18. My question is this, under this act when an employer pulls my criminal history or a background check, what do they see? I was told that if i succesfully went throught the FOA/P that i could/should answer that i have NOT been convicted of a felony, is this true? can someone explain this law to me?

Re: Georgia's First Offender ACT / LAW

In short - if you successfully completed the terms of your First Offender sentence, the arrest will still appear, but the final disposition will be blank OR it will show that you completed the case under First Offender status. If you did successfully complete your sentence (i.e. your First Offender status was never revoked by an order of the court) it is true that as to that case, you were not CONVICTED of the charge(s). I hope this helps.

Sincerely,

Chris Westmoreland
