You left out many details that affect the answer. Where was he carrying it? How big was it? How was he carrying out? How old is he? Does he have a criminal or juvenile record? Depending on the details you omitted the answer could be yes or no.

See O.C.G.A. 16-11-101- Whether a knife is illegal, i.e. used as a weapon by a minor is a jury question. If you know someone who is facing this type of charge, hire a lawyer if possible. Obviously some knives are not questionable, i.e. pocket knives, scouting knives, etc. However, if you have a minor is carrying around a hunting knife that is a different story entirely.

Equally important, is how, when, and where the minor obtained the knife.

Feel free to contact our firm if you have questions or concerns.

Best of luck,
