Legal Question in Criminal Law in Georgia

simple possesion of marijuana

I was pulled over for not having my lincense plate illuminated, and the cop asked for my drivers license, then without running it he asked if he could search my car. I tried to say it was my dads car, but he said that i was driving and i could consent. I went ahead and told him he could search, he then found a bag of marijuana. they then placed me in handcuffs, without reading me my rights, and took me to jail. Im now charged with possesion, and im wondering if the cop followed procedure? And if there is anyway to get this case dropped? Im trying to be a teacher and this would prevent me from doing so.

Re: simple possesion of marijuana

It's possible that the officer did something wrong in the stop, especially considering the fact that he only pulled you over for your license plate not being illuminated.

He doesn't have to read you your rights unless he is questioning you, so that doesn't matter.
