DUI Prescription drugs

MY wide was stopped for having no tag, they serched car found prescrition meds. on the bottle it says use caution,, it doesnt' say you cant drive she agreed to a urnine test, she is charged with dui by drugs. on the bottle it doesnt' say she can t drive and she is to take up to 4 times a day in witch she had only taken up to two at that time. Can we beat this in court.. thank you so much for your advice.

You can still be charged with DUI if your injestion of the prescription, whether lawfully obtained or not, causes you to be impaired to the extent that you are a "less Safe" drivier. It's hard to say whether you can beat the DUI in court. Your wife's demeanor at the time of the stop will be a major consideration. The type of prescription drug she possessed will also be sgnificant.
