Legal Question in DUI Law in Georgia

statute of limitation for failure to appear on dui case

I received a dui in the state of georgia in 1992, but i moved out of state before my court date, After 12 years i still have a warrant in the state of georgia for failure to appear, is there a statute of limitation for failure to appear?

The statute of limitations applies to the State in bringing the charges initially. It has been satisfied by your arrest for DUI and the issuance of the Uniform Traffic Citation, in my opinion. You will have to deal with the failure to appear in order to get it handled and off your record.

Yes the previous answer is correct...the warrant will always be active until its cleared, typically by your arrest. I had a DUI client from Boston in the exactly the same situation, except his warrant was 18 years old!

I agree with the prior two responses. However, you should have a consultation with a Georgia lawyer. Further, check you Geogia driving record to see what it indicates. If, in fact, it lists the outstanding Geogia DUI, Illinois will require that it be cleared before they issue a license to you.
