Elderly Lady in Need of Help

My mother is 86 and suffers from mild dementia. She had a stroke last January that did no physical damage but aggravated the dementia. After the stroke, she gave my older brother power of attorney. She had a live-in sitter throughout the summer. After a hospitalization with pneumonia in November, my brother admitted her to a nursing home against her (and my) wishes. Her doctor said she could go back home with a sitter. She has the resources to afford this. My brother refuses to allow her to leave the institution. Because I am not listed as the ''responsible party,'' the nursing home will not discuss my mother's care with me but routinely talks to my brother's wife who is a nurse. My mother is very unhappy. They have placed her on anti-anxiety meds. What can I do? She is declining fast.

You need to see a lawyer who specializes in, and has a lot of experience in, elder law. It is a fairly specialized area. Seek referrals, check websites, etc.
